You must read our terms and conditions of sale stated below before placing your order as all orders are accepted on these terms and conditions.

If you are under 16, we require that you inform a parent or guardian about GIDDY BALM Privacy Policy and Terms and Conditions as well as requiring their consent to the Privacy Policy and Terms and Conditions before registering with GIDDY BALM or placing an order with GIDDY BALM.

By accessing the website and / or placing an order you agree to be bound by these terms and conditions regardless of whether you register with us or place an order. You are advised that not registering with GIDDY BALM is not detrimental to you being able to place an order with us.

If you do not understand any of the terms and conditions or if anything is unclear then please call us – we will be pleased to explain any of the terms to you.

We reserve the right at any time to update, change, or replace any part of these terms and conditions by updating this page. You should check this website from time to time to review the current terms and conditions because they are binding on you. If you do not wish to accept any terms and conditions, you should not continue to use this Website or use any services.

These terms and conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

  1. ACCESSING OUR SITE

Access to www.giddybalm.com is permitted on a temporary basis, and we reserve the right to withdraw or amend our site or any part of it including the goods and services we provide on our site without notice. When using our site, you must comply with the provisions of our acceptable use policy (see below).

Acceptable Use Policy

You may use our site only for lawful purposes. You are responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms of Use and that they comply with them. You may not use our site:

  • In any way that breaches any applicable local, national, or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive upload, download, use, or re-use any material which does not comply with our acceptable use policy.
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

By breaching this acceptable use policy, you could commit a criminal offence under the Computer Misuse Act 1990. Failure to comply with this acceptable use policy constitutes a material breach of these Terms of Use, and may result in our taking all or any of the following actions:

  • Immediate, temporary, or permanent withdrawal of your right to use our site.
  • Issue of a warning to you.
  • Take legal proceedings against you for reimbursement of all costs on a pound for pound basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you. and/or
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

  1. SITE ASSURANCE AND INFORMATION DISPLAYED

We update our website on an ongoing basis and may change the content at any time. You should note that any of the material on our site may be out of date at any given time, and we are under no obligation to update such material. GIDDY BALM reserves the right to withdraw or amend the goods and services (including prices) we provide on our site without notice. From time to time, we may restrict access to some parts of our site, or our entire site to users who have registered or not registered with us. If the need arises, we may suspend access to our site, or close it indefinitely.

Any commentary, content, or materials displayed on our site are not intended to amount to advice on which reliance should be placed. Specific professional or specialist advice should always be sought before doing anything on the basis of the commentary, content, or materials displayed on our website.

  1. OUR PRODUCTS

The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the Products. Your Products may vary slightly from those images.

All sizes and measurements of Items are approximate, however, we do make every effort to ensure they are as accurate as possible. We take all reasonable care to ensure that all details, descriptions, and prices of Items are as accurate as possible.

To enable GIDDY BALM to offer a range of products some goods may from time to time be  sold as non-stock items available on back-order. Whilst we clearly list shipping timescales for back-orders as a guide GIDDY BALM will inform the customer by email if we foresee a delay in receiving goods. This does not affect your rights to cancel your order, see section 10.

The packaging of the Products may vary from that shown on images on our site. All Products shown on our site are subject to availability. GIDDY BALM reserves the right to refuse orders where information about Items has been mis-published, is not available, including without limitation prices and promotions, and will inform you by e-mail as soon as possible and not process your order if made.

Gift Cards and Store Credit

You can purchase gift cards or Store Credit online from GIDDY BALM website (“Gift Card”). Your Gift Card or Store Credit can be used by you if you are the purchaser or a Gift Card can be given as a gift. You will receive the option to have your gift card code emailed to you or emailed to another recipient as a gift. You can use the gift card code in full or part payment for goods purchased on GIDDY BALM website. Gift Cards or Store Credit cannot be used for purchases on other online stores.

Gift Cards or Store Credit is not for re-sale and cannot be exchanged for cash. No change or refund will be given. A Gift Card or Store Credit code will not be honored if sold. GIDDY BALM will not be responsible if your Gift Card or Store Credit code is lost or stolen. It will not be replaced or its value refunded in any of these circumstances.

The value of your purchases will be deducted from the balance on your Gift Card or Store Credit when entering your code at the checkout; any remaining balance can be used against future purchases.

You can purchase as many Gift Cards or as much Store Credit as you like. Gift Card and Store Credit codes can be used concurrently by entering the codes at the checkout.

If any payment credited to the Gift Card or Store Credit is subsequently dishonored this will result in the credit to your Gift Card or Store Credit being withdrawn.

The Gift Card or Store Credit will automatically expire after 12 months, this is from the date of purchase when you were emailed your gift card or store credit code. It is your responsibility to check your expiry date, if you are unsure for any reason or would like us to check for you please email giddybalm@gmail.com. Any remaining balance will be deducted after 12 months.

Please be aware Gift Cards or Store Credit are non-refundable as stated in section 10 of our terms and conditions.

  1. PRICING, DESCRIPTIONS, AND AVAILABILITY

Prices shown on the website are excluding VAT. If a customer needs confirmation of taxes before placing their order please email giddybalm@gmail.com and we will be happy to advise whether VAT applies. The price of a product does not include delivery charges. Our delivery charges are explained in our terms and conditions in section 8 and on our website under delivery and shipping. Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

If we are unable to contact you we will treat the order as canceled. If you choose to cancel your order because of an error and you have already paid for the goods, you will receive a full refund.

Goods’ prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent to you.

  1. PAYMENT & SECURITY

Orders may only be processed online, using PayPal or a credit or debit card (currently VISA, Maestro, Mastercard, ApplePay, American Express, JCB, Dinners Club International, and Discover Network) via Stripe Payments Europe, Ltd (“Stripe”) and PayPal. Your card provider may charge you for using your card. Please check the terms and conditions with your card provider carefully and in advance of submitting your payment details.

Gift Cards or Store Credit purchased from GIDDY BALM (“Gift Card”) may also be used to process orders online. You can use a gift card or store credit in full or part payment for goods purchased on our website. The gift card or store credit cannot be used for purchases on other online stores. The value of your purchases will be deducted from the balance on your gift card or store credit when you enter the code at our checkout; any remaining balance can be used against future purchases. The gift card or store credit is not for re-sale and cannot be exchanged for cash. No change or refund will be given. For more information about our gift cards or store credit see section 5 of our terms and conditions and on our website under “Gift Cards”.

All information you provide to us is stored on secure servers. GIDDY BALM have chosen to use Sage Pay, Stripe Payments Europe, Ltd (“Stripe”), and PayPal as our payment gateways. Information you provide us with will be encrypted using SSL technology. Payment transactions are managed off-site using Sage Pay, Stripe Payments Europe, Ltd (“Stripe”), and PayPal. Sage Pay, Stripe Payments Europe, Ltd (“Stripe”), and PayPal are responsible for capturing and storing all of the customer’s sensitive payment information, this information is never stored with GIDDY BALM. Offsite payment processors have their own security standards, certificates, and methods of securely passing data from and to our store. Stripe Payments Europe, Ltd (“Stripe”) and PayPal ensure that all your credit card details are encrypted and sent securely between you, your bank.

We would also recommend customers sign up to 3D Secure as an extra level of security when purchasing online. 3D secure is an extra page you would see after entering card details, some card issuers already offer this protection however it is not compulsory.

GIDDY BALM do not store any of your payment details on our Website. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Your credit card company may also carry out additional security checks. In the event, your card is declined please contact your card issuer if you wish to authorise the transaction.

  1. DELIVERY

GIDDY BALM use Royal Mail for postal services, and DHL, Parcelforce, and other selected couriers for larger deliveries.

ALL ABOUT GYMNASTS aim to dispatch all orders within 1-3 working days of receiving cleared funds. We are currently unable to dispatch orders on Saturday, Sunday, and UK Bank holidays. Where non-stock item products are purchased and marked “back-order” you agree to the estimated delivery period as stated in the product header and product description. Orders received after 4 PM will be dispatched the following day.

International Delivery

We deliver to some countries outside the UK. You have to select the country where you want the Goods delivered from the drop-down box as part of the ordering process (Delivery Destination), if your country is not listed, we do not currently deliver to that country. To see the current list of countries we deliver goods, see section “Delivery and Shipping” on our website. If your country is not listed please enquire if we can deliver to your country email giddybalm@gmail.com for a quotation.

If you order Goods from our site for delivery to a European Delivery Destination, the customer (you) will be the importer and your order may be liable for any customs and import duty, quotas, permits, product restrictions, and other local requirements. These charges must be paid by the recipient of the package. Although the EU-UK Trade and Cooperation Agreement refers to ‘zero tariffs’ (zero customs duties), we will now need to generate a Customs Declaration and so a Commercial or Pro-forma Invoice is required. The trade deal only applies to Customs duties, meaning that in most cases Customs duties will not be applied to goods fulfilling all necessary “rules of origin” requirements. However, VAT will still be levied. Customs declarations are therefore required for goods to clear the border, as the UK will have left the single market and the customs union. Customs policies vary widely from country to country. It is important you check the requirements of your country before placing an order. Please note that we have no control over these charges and we cannot predict their amount. Please contact your local customs office for further information before placing your order.

If you order Goods from our site for delivery to an International Delivery Destination, the customer (you) will be the importer and your order may be liable for any customs and import duty, quotas, permits, product restrictions, and other local requirements. You must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable or responsible if you break any such law.

The above does not affect your statutory rights as a consumer.

Orders despatched by Royal Mail.

Royal Mail postal services aim to make one delivery every day, Monday to Saturday and normally operate between 9 am – 4 pm (subject to exceptions for remote areas with limited transport infrastructure such as the Highlands and Islands). For Guaranteed Saturday Special Delivery please contact giddybalm@gmail.com. GIDDY BALM send post 1st Class unless you select another service like Special Delivery or Tracked.

Estimated Delivery Days

  • UK – aim to deliver 1 -3 working days.
  • Europe – aim to deliver 3 – 5 working days.
  • Rest of the World – aim to deliver 5 – 7 working days Internationally Tracked.

Royal Mail does not usually collect or deliver on the bank and public holidays.

Please note that while items sent by Royal Mail usually arrive within 1-3 days in the UK, Royal Mail stipulates that only items still not delivered after 10 working days can be officially classified as lost in the UK. Royal Mail aims to deliver International mail within 3 – 7 days although mail will not be classified as lost after 20 working days from the due date in Europe, and after 25 working days for the rest of the world.

Orders despatched by DHL, Parcelforce or Other Couriers

Our couriers require a signature and operate between 9 am and 6 pm on weekdays.

Please ensure you specify an address where someone will be able to sign for your order between these hours, alternatively have your order delivered to your work address. Our courier services are fully trackable.

Estimated Delivery Days

  • UK – aim to deliver the next working day if order received before 10 am.
  • Europe – aim to deliver 2 – 5 working days.
  • Rest of the World – aim to deliver 3 – 8 working days.

Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence of the Contract. GIDDY BALM shall not be liable whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any delay in delivery of the Goods that is caused by a Force Majeure Event or Customer’s failure to provide the supplier with adequate delivery instructions or failure to take or receive delivery of Goods.

If a Customer fails or refuses to accept delivery of the Goods after two (2) attempts, then, except where such failure or delay is caused by a Force Majeure Event or Supplier’s failure to comply with its obligations under the Contract, then the Goods shall be returned to GIDDY BALM and the Customer shall be responsible for any costs relating to the delivery attempts and subsequent return to GIDDY BALM including transportation, insurance, and storage costs, which costs shall be either deducted from the customer’s original order payment or invoiced by GIDDY BALM and paid by Customer.

  1. ORDERING AND WHEN YOUR CONTRACT IS FORMED

You are deemed to place an order with us by ordering via our online checkout process. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read, check, and correct any errors in your order before completing the checkout process. We will send you an order acknowledgment, detailing the products you have ordered.

The fact that you receive an automatic order acknowledgment does not necessarily mean that we will be able to fulfill your order.

Our acceptance of an order takes place when we dispatch the order. The Contract between us will be formed when we dispatch the order. Once we receive an order from you, the price of the goods comprising that order will be valid for a period of 30 days. For Goods on “back-order” this period is extended for a further period that is stated in the products short description, main description, and in our delivery and shipping terms on our website. If we are unable to dispatch the Goods to you within the agreed period of receipt of your order, or if the price of the Goods changes before the end of the period from the date on which we receive your order, we reserve the right to contact you and let you know the new price. You will then have the option to either cancel your order in accordance with section 10 or inform us that you wish to continue with the purchase at the new price.

The Contract will relate only to those Goods whose dispatch we have confirmed in the dispatch confirmation email. We do not have to supply any other Goods which may have been part of your order unless and until the dispatch of such Goods has been confirmed in a separate email dispatch confirmation.

We may refuse to accept an order:

  • where goods are not available;
  • where we cannot obtain authorisation for your payment;
  • if there has been a pricing or product description error;
  • if you do not meet any eligibility criteria set out in our terms and conditions.

We will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount as soon as possible.

  1. CONTRACT CANCELLATION UNDER THE EU CONSUMER RIGHTS DIRECTIVE:

Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.

If your order consists of multiple goods, the 14 day period runs from when you get the last item of your goods.

If you wish to exercise your right to cancel this contract after your order has already been dispatched, we will refund the original purchase price, provided that you have notified us in writing no longer than 14 days after the day on which you receive the order, and that you have taken reasonable care of the products and not used them.

Your cancellation form should be included with your purchase. Should you not be able to find a copy of the cancellation form you can request a copy or simply email us your right to cancel at giddybalm@gmail.com.

It is the buyer’s responsibility to pay the postage costs for the return of goods unless the Buyer can provide conclusive evidence proving that the goods are damaged or have a manufacturers fault.

For bulky goods, UK returns with a courier service are estimated to be £15.00. For return bulky goods outside of the UK we estimate charges can range between £30.00 and £100.00 however it is the responsibility of the customer to check this as prices will vary from country to country.

GIDDY BALM will refund the cost of your original delivery fee where the product is faulty or damaged.

Please note that your right to return Products does NOT apply to products that fall into the following categories unless they are faulty or not as described:

  • Made to measure or personalised goods
  • Gift Cards or Store Credit
  • Perishable goods (such as flowers and chocolates).
  • Unsealed software, CDs, DVDs.

To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

If you are returning any item, you should consider using proof of delivery, trackable shipping service, or purchasing shipping insurance. We cannot guarantee that we will receive your returned item.

  1. RETURNS POLICY

For returns made outside the EU Consumer Rights Directive, we will refund the value of the goods returned to us, at the price you purchased them less postage cost.

It is the buyer’s responsibility to arrange and pay the postage costs for the return of goods unless the Buyer can provide conclusive evidence proving that the goods are damaged or have a manufacturer’s fault.

Where goods are being returned within the European Union and other International destinations a declarable shipment is being returned then a copy of your original invoice and our Returns Form (stating reasons for your return) must also accompany this return in order to avoid unnecessary delays or Customs charges. Your invoice and Returns Form (click here) should be attached to the external package in a resealable bag or equivalent.

GIDDY BALM will refund the cost of your original delivery fee where the product is confirmed faulty or accepted as damaged and will also pay the cost of returning the goods to GIDDY BALM. We will refund any money received from you using the same method originally used by you to pay for your purchase.

In all cases of unwanted items, the products returned should be in their original condition, unworn, complete with any labels, instruction booklets or software and packaging. All goods will be inspected on return. In cases where the value of the returned goods has diminished as a result of handling which goes beyond what would be possible in a store, we are entitled to recover any amount up to the full contract price.

GIDDY BALM reserves the right to charge a re-stocking fee where FREE delivery has been applied.

Exclusions

Certain products and services are excluded from this return policy, including made to measure, personalised goods, gift cards and store credit, perishable goods (such as flowers and chocolates), and unsealed software, CDs, DVDs.

These items cannot be returned for a refund unless faulty.

It is the responsibility of the customer to check the details of any Personalisation requested at the point of placing the order. These items will be made to that exact specification. In cases where the personalisation has not commenced, we will accept alteration requests which are made in writing via email once the alteration has been authorised by our team.

If you feel you have made an error with your personalisation order please contact us via email with your order number at giddybalm@gmail.com and we will make every effort to assist you with any change necessary to complete the order to your satisfaction.

GIDDY BALM will refund the cost of your original delivery where the product is faulty or confirmed damaged, however for unwanted items we shall not refund the original delivery fees. If you are returning any item, you should consider using proof of delivery, trackable shipping service, or purchasing shipping insurance. We cannot guarantee that we will receive your returned item.

We will make the refund directly to the credit/debit card or Pay Pal account used to place the original order within 14 days of receipt or earlier, once we have inspected the returned item and are satisfied that it has been returned to us in the condition it was in when delivered to you.

The goods are your responsibility until they reach our Warehouse. Please ensure you package your items carefully to prevent any damage to the items or boxes. We are not responsible for any items that are returned to us in error.

We recommend you use a secure delivery method that requires a signature upon receipt (such as Royal Mail First Class Recorded Delivery) or courier for larger shipments. For larger shipments, you should consider using a trackable shipping service or purchasing shipping insurance. In the rare event of a shipment going missing, you are responsible for the returned products until they reach us. We cannot guarantee that we will receive your returned item.

The above does not affect your statutory rights.

  1. FAULTY OR DAMAGED GOODS

You may return Goods to us in accordance with our terms and conditions section 11 Returns Policy or, where you consider that the Goods are defective.

If you wish to return Goods to us because you consider that the Goods are defective please contact us and provide evidence in the first instance.

Where goods are determined damaged by you GIDDY BALM reserve the right to charge customers for the repair of damaged goods and any postal charges incurred. Any repairs will be discussed and agreed in advance of any works being carried out. Unfortunately, items that have been worn, damaged, or altered cannot be accepted for a refund or exchange.

If we agree that the Goods are defective GIDDY BALM reserve the right to consider any fault or damage be repaired. Should this not be possible you will be issued a new replacement or a full refund. If you decide you would like a refund GIDDY BALM will refund the price of the Goods and will notify you of any refund due within a reasonable period of time and if a refund is due we will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you that you were entitled to a refund.

GIDDY BALM will refund the cost of your original delivery fee where the product is confirmed faulty or accepted as damaged and will also pay the cost of returning the goods to GIDDY BALM. We will refund any money received from you using the same method originally used by you to pay for your purchase.

Where you are entitled to a replacement we will deliver to the address where the original order was delivered to.

You will always have legal rights in relation to Goods that are faulty, damaged, or not as described. These legal rights are not affected by the returns policy or these terms and conditions. Advice about your legal rights is available from your local Citizens Advice Bureau or Trading Standards office.

GIDDY BALM take the security of our customer’s details very seriously and as such have measures in place both on our website when creating an account and when taking payment to ensure your details are kept safe.

All information you provide to us is stored on secure servers. Information you provide us with will be encrypted using SSL technology. Payment transactions are managed off-site using PayPal or Stripe. Please note that we do not collect or process your credit or debit card details. These are however collected and processed by our payment processing service provider Stripe Payments Europe, Ltd (“Stripe”) and PayPal. The collection and processing by these providers of your credit or debit card details and other personal data are governed by their respective terms and conditions. Offsite payment processors have their own security standards, certificates, and methods of securely passing data from and to our store. Where we have given you (or where you have chosen) a password that enables you to access certain parts of our website, you are responsible for keeping this password confidential. You must not share this password with anyone.

Whilst GIDDY BALM take security seriously registered customer account holders are reminded to protect their GIDDY BALM Account, keep their password confidential. You are responsible for the activity that happens on or through your Account. Try not to reuse your GIDDY BALM Account password on third-party applications.

Here are some simple steps to ensure your account remains secure;

  1. Check for viruses and malware. Run a scan on your computer with trusted anti-virus software. If the scan detects any suspicious programs or applications, remove them immediately.
  2. Perform regular operating system and browser updates. Make sure you’ve set your computer to update automatically. If you get a notice to update, take care of it right away.
  3. Never use your GIDDY BALM Account password on another website. If you enter your password on an external website and it’s compromised, someone could try to sign in to your Account with the same information.
  4. Protect your password. Never enter your password after following a link in an email from an untrusted site. Always go directly to GIDDY BALM website.
  5. Use a strong password. Don’t write it down, send it via email, or tell anyone. GIDDY BALM will never email you to ask for your password or other sensitive information.
  6. Always sign out of your account at the end of each user session. At the top of the page, select My Account then, select logout.
  7. Change your password. Consider updating your password after a suitable period.
